Answer1. + work can't have been included in the contract
2. owner ordered the extra work
3. owner had to agree to pay extra
4. contractor didn't voluntarily do the extra work
5. extra work can't be the contractor's own fault.

    I didn't realize that an oral modification to the contract was possible. I'll go back to scan the documents now.
