Statute of Limitations - Architect

While the statute of limitation is the extent of time that a legal claim can be made after the condition is discovered, the statute of repose is the time within which one has to make the discovery. What is the total length of exposure to potential claims for a design professional in a state with a 2 year statute of limitation for professional negligence and a 12 year statute of repose?

Answer10 years. AIA design professional contract language negates the discovery or repose period. An important change in AIA B201-2007 is to effectively cap the statute of limitation at 10 yrs. In states with longer statutes of limitation or repose, unless stricken the Owner adopts this provision in the agreement.
